MPTC and Cavitex Infrastructure Corp recently issued a press statement addressing the ongoing legal situation surrounding PEATC OIC Dioscorro Esteban Jr.’s Mandamus petition. The statement clarified several key points regarding their roles and responsibilities within the Manila Cavite Toll Expressway Project (Cavitex) and the Manila Cavite Toll Expressway Project (MCTEP).
Firstly, MPTC and Cavitex Infrastructure Corp emphasized that Cavitex’s Operations and maintenance (O&M) fall under the jurisdiction of PEATC, as stipulated in the Joint Venture Agreement (JVA). They highlighted that any operational complaints related to Cavitex should be directed to PEATC.
Additionally, they mentioned that contracts for various services, such as security, maintenance, and employee benefits, are extended by CIC upon the request of PRA, without requiring approval from the PEATC Board due to governance concerns.
Regarding the ongoing MCTEP project, they discussed the Cavitex-C5 Link, which aims to alleviate traffic congestion in Parañaque, Pasay, and Taguig, with a projected capacity of accommodating around 50,000 vehicles daily.
In response to PEATC OIC Esteban’s Mandamus petition, MPTC and Cavitex Infrastructure Corp asserted that Esteban lacks the authority to file such a case without approval from the PEATC Board, which is currently non-existent. They deemed this action a violation with deliberate intent to mislead the public and stakeholders.
They also mentioned their efforts to resolve disputes through the JVA’s dispute resolution mechanism, offering cooperation but highlighting the absence of necessary reports from PEATC since 2007.
Finally, they expressed confidence that the Court of Appeals should dismiss the case based on procedural flaws and the lack of proper authority from PEATC or PRA Board, emphasizing the necessity of proper legal counsel oversight.
